If married in community of property, your spouse also will have to apply for Debt Review.
If you are in the process of getting a divorce, your spouse will also have to apply. Or you can apply for Debt Review on your own after the divorce has been finalized.
Once you have applied for Debt Review you will be flagged on the Credit Bureaus as being under “Debt restructuring”. This is good, because this means that no Credit Provider can take legal action against you unless you default on payments. One of the consequences to keep in mind is that the moment you apply for Debt Review, you cannot apply for credit until you have completed the Debt Counselling Process. The process is completed the moment all of your accounts have been paid up and a Clearance Certificate has been issued.
It is also very important to be open and honest with your Debt Counsellor at all times. List ALL of your Credit Providers from day one in order to speed along the process and avoid unnecessary complications in the future.
